And Miss Emilia Lemmelin, of the city of Montreal, a major daughter of the legitimate marriage of Mr. Narcisse Lemmelin, mechanic, of the same place, with Dame Delina Heroux, stipulating for herself.
On the other hand.
Which have decided as follows the civil conventions of the planned marriage between them, namely:
The future expoux will be separated from property, in accordance with the provisions of articles 1422 and following of the civil code: consequently, the future wife will have the free enjoyment of her income, she will be able on her simple receipts to touch and collect all sums of money due to her. and in a word it will be able to do all the acts of the most complete administration.
The future spouses will not be held liable for each other's debts created before or during the duration of this marriage.
The future bridegroom will be the only one held at the expense and expenses of the present future marriage, the future wife giving up so much for herself as for the children who could be born of the present future marriage.
In consideration of the present future marriage and also in consideration of the above waiver, the future spouse makes a donation to the future bride, accepting, of a sum of three thousand dollars ($ 3,000.00), which sum will be paid by the future spouse to the future wife as and when necessary shall be and shall be used exclusively for the purchase of furniture and household effects to be used to furnish the matrimonial property, which furniture and household effects shall be exempt from seizure, although transferable.
However, it is expressly agreed that if the future wife dies before the bridegroom, the furniture and household effects which will have been acquired from the amount of three thousand dollars which is the object of the donation above, will in fact become even the absolute property of the future spouse.
In addition, in consideration of the present future marriage and the above waiver, the deceased spouse shall be transported to the spouse, accepting, as a survival benefit, the benefits of an insurance policy in the amount of one thousand dollars. the future spouse has made the Metropolitan Life Insurance Company insure his pure life: consequently, the future spouse expressly revokes by the present all previous imputation of the profits of this insurance policy, and he undertakes to have the said insurance company carry out and accept, as soon as possible after the celebration of the present future marriage, all transportation of the benefits of the said insurance policy in the sense of the donation above, and he furthermore undertakes to maintain this so-called insurance policy in force by regularly paying the premiums.
Finally, it is expressly agreed that, in the event of the death of the future wife after the future spouse or his second marriage, without there being any child born of the present future marriage, the furniture and household effects which will have been acquired even the sum of three thousand dollars that makes.
